This Privacy Policy is addressed to any current clients or prospective clients (“you” or “your”) whose Personal Information NCM collects and controls to conduct its business, including on our website (“Site”).

This Privacy Policy describes how we collect and use Personal Information (as defined below) about you during and after your working relationship with us. This Privacy Policy describes the basis upon which and for what purposes we process your Personal Information, as well as your privacy rights under certain privacy laws including, where applicable, under General Data Protection Regulation (“GDPR”) and applicable U.S. privacy laws, and how we protect your Personal Information.

What Type and Sources of Information We Collect

We collect certain personal information that may directly, or indirectly, identify you, including nonpublic personal identifying information (“Personal Information”) from information that you provide on applications or other forms as well as communications (electronic, telephone, written or in person) with you or your authorized representatives (such as your attorney, accountant, etc.). We also collect information about your brokerage accounts and transactions.

The types of Personal Information we collect and share depends on the service you have with us. This information can include:

  • personally identifying information such as name, social security number, telephone, address, date of birth, and marital status;
  • digital footprint data such as e-mail,
  • biographical data such as age and gender;
  • employment data such as salary information, job position, and tax information;
  • financial information such as purchases, sales, account balances, inquiries, bank information, income, account balances and assets, transaction history, pension, etc.

 

What Personal Information Do We Collect When You Visit our Site?

When you visit our Site, we may collect information from you when you access your account through our “Client Center” which includes your login information. We do not collect any other personal information on our Site.

 

How is your Personal Information Used?

We will only use your Personal Information with the purpose of providing you with our investment management and financial planning services. We will use your Personal Information to:

  • monitor, audit, evaluate and otherwise continue to administer our services and conduct business processing functions including the provision of your Personal Information to our contractors, service providers or other third parties;
  • communicate with you and respond to your inquiries;
  • protect against, identify and prevent fraud, copyright infringement, unauthorized use and distribution of protected content and other unlawful activity, claims and liabilities;
  • conduct investigations and comply with and enforce applicable legal requirements, relevant industry standards, contractual obligations and our policies and terms; and/or
  • for other purposes required or authorized by law, including other purposes for which you have provided your consent.

Where required by applicable law, we obtain consent to process Personal Information.  In the event that we use Personal Information we collect for other purposes not identified above where direct client consent is required under applicable rules, laws and/or regulations we will provide specific notice at the time we collect such Personal Information.

 

What Information We Disclose

All financial companies need to share client’s personal information to run their everyday business. We do not disclose the nonpublic personal information we collect about our clients to anyone except:

  • in furtherance of our business relationship with them and then only to those persons necessary to affect the transactions and provide the services that they authorize (such as broker-dealers, custodians, independent managers, etc.);
  • to persons assessing our compliance with industry standards (e.g., professional licensing authorities, etc.);
  • our attorneys, accountants, and auditors; or
  • as otherwise provided by law.

We are permitted by law to disclose the nonpublic personal information about you to governmental agencies and other third parties in certain circumstances (such as third parties that perform administrative services on our behalf). These third parties are prohibited to use or share the information for any other purpose. If you decide at some point to either terminate our services or become an inactive client, we will continue to adhere to our privacy policy, as may be amended from time to time.

Limits on Sharing

To the extent U.S. Federal laws apply to your personal information, you have the right to limit only:

  • Legitimate Interests: processing is necessary to the legitimate interests of our firm and/or a third party.

  • to have your personal information corrected, for example, if it is incomplete or incorrect;

To the extent permitted by applicable law, we retain your personal information for the period necessary to serve the purposes for which we obtained it.
